Senior Counsel Carl Zwisler is quoted in the Franchise Times article “Attorneys Share Interesting Cases and How They Spent COVID Downtime.” In the article, Carl discusses a case representing a major foreign franchisor entering the U.S. The client’s affiliate had previously granted master franchise rights for North America to a different company. Although the rights had been terminated prior to granting rights to the client, regulators initially required the client to refund fees to existing subfranchisees that has been paid to the previous master.
“Through negotiations with the regulator, including representatives of both the examination and enforcement divisions, we were able to reach a resolution—after nearly two years," said Carl.
