President Trump’s second term has produced a wave of administrative actions—more than 250 Executive Orders alone have been issued since January 20, 2025. These directives cover a wide range of business‑critical issues, including tariffs, immigration, healthcare, workforce rules, investigations and enforcement, and federal regulatory authority.

To help business leaders navigate this often-confusing landscape, join Lathrop GPM’s Executive Actions Task Force attorneys for a 60-minute overview of the legal boundaries of Executive Orders – identifying those administrative actions most likely to affect businesses and outlining practical strategies for risk mitigation.

What we’ll cover:

Executive Orders vs. Agency Actions

Generally, our Constitution envisions a legislature enacting the laws of the republic, so where does the executive branch and its authorized orders and actions fit in? How do these, sometimes confusing, distinctions affect the implementation and reach of Executive Orders?

Corporate, White Collar & DOJ Investigations

We will provide an overview of the evolving federal enforcement landscape and its impact on companies and individuals operating across borders. We’ll explore shifting DOJ enforcement priorities, updates within key federal divisions, and emerging trends in False Claims Act and IRS Criminal Division activity. Our discussion will outline best practices for navigating corporate, criminal tax, and white‑collar investigations, including what organizations and executives should do when facing government scrutiny.

Trade, Tariffs & Supply Chain Volatility

On February 20, the Supreme Court issued a long-awaited decision on the legality of President Donald Trump’s worldwide tariffs, in which it held that tariffs imposed by the president under the International Emergency Economic Powers Act are invalid (though it is unknown whether the president’s subsequently issued imposition of tariffs under other claimed authorities will be similarly invalidated). To date, U.S. importers and consumers have paid an estimated $175 billion in IEEPA tariffs, and a federal judge has now cleared the way for businesses to receive refunds (though the payment process remains unclear). What happens now?

Immigration & Workforce Enforcement

We will cover the rise in worksite inspections and unanticipated ICE actions, along with employers’ obligations during workplace searches and audit scenarios. Our discussion will also address shifting immigration dynamics, including increased Requests for Evidence, sponsorship challenges, and processing delays.

The overview will further examine recent reversals in independent contractor rules and the movement toward more employer friendly classification standards. In addition, attendees will gain insight into workforce dynamics under the current administration, potential travel limitations for employees, and the growing importance of clear, proactive employer communication.

Healthcare & Nonprofit Impacts

On the healthcare side, our discussion will explore policy shifts related to the “Make America Healthy Again” agenda, upcoming changes to Affordable Care Act insurance markets, new Medicaid work‑requirement initiatives, and the evolving enforcement environment impacting providers. Practical steps organizations can take now to mitigate risk across both sectors will also be highlighted.

And on the nonprofit side, we will discuss current threats to nonprofit tax‑exempt status associated with work with immigrant communities, environmental advocacy, DEI programming, and political activity, as well as key considerations in federal contracting and FCA compliance.
