Lawsuits alleging violations of wage-and-hour laws are rampant in California and a plague on employers. Most wage-and-hour cases are now filed as class action suits and include a request for penalties pursuant to the Private Attorneys General Act (PAGA), creating “bet the company” litigation for some employers. Many employers do not understand class action and PAGA cases, however, or know how to reduce the risk of these claims. Our presentation focuses on these important questions:
- What is a class action case?
- What is a PAGA claim, and how is it different from a class action?
- How are class action and PAGA cases resolved?
- What can employers do to reduce their risk of a class action and/or PAGA suit?
