Gabrielle Intagliata is an associate in the firm’s Litigation & Dispute Resolution practice group, specializing in trust and estate litigation. Gabrielle represents a variety of clients, working with institutional trustees to minimize risk, comply with their fiduciary duties, and find solutions to potential disputes before they arise, and representing individual beneficiaries, advocating for their rights, and helping them find desirable resolutions to the often-complex situations which arise in relation to estates and trusts. Gabrielle also works to protect the interests of nonprofit and university beneficiaries in estate disputes.

Gabrielle handles disputes concerning wills, trusts, and probate matters. Gabrielle has represented clients in disputes in actions seeking an accounting of trust, removal of trustee and appointment of a new trustee, and alleging breaches of fiduciary duties. Gabrielle handles all aspects of litigation, including witness preparation, taking and defending depositions, drafting and replying to motions for summary judgement and other pre- and post-trial motions, and serving as first and second chair at trial. While her main focus is trust and estate litigation, Gabrielle also works on general commercial and business litigation – handling contract disputes between corporations, foreclosure matters, and eviction work.

Client service is at the heart of Gabrielle’s practice. She recognizes that each client comes with a one-of-a-kind set of goals and challenges and is committed to prioritizing their best interests. This dedication extends to her willingness to explore a variety of avenues, whether it be through the litigation process or by seeking alternative solutions that can effectively circumvent the need for litigation. Gabrielle has successfully resolved matters prior to litigation through mediation and pre-litigation settlements. Gabrielle’s comprehensive and client-centric approach ensures that her services are tailored to the specific needs and preferences of each individual and organization she represents.

Gabrielle has a strong interest in serving the needs of small and closely-held businesses. With her family’s ownership and operation of a business in Arnold, Missouri, specializing in the production of heating and air conditioning systems, she possesses a unique blend of personal and professional interest in helping families structure their businesses and plan for the future.

Prior to joining Lathrop GPM and shifting her practice to focus on trust and estate litigation, Gabrielle worked on matters ranging from trade secret protection and non-compete and non-solicitation employment cases to zoning disputes with local municipalities.

Gabrielle is committed to giving back to the St. Louis community, working closely with St. Louis Bar Association each Christmas season to lead the Motion for Kids drive, a program designed to provide presents to children impacted by the foster system. Gabrielle also serves on the Board of Directors for Missouri CASA (Court Appointed Special Advocates), an organization that provides advocacy for abused and neglected children under the court’s jurisdiction.

Experience

  • Represented a non-profit organization in an estate dispute, involving issues of cy pres, abatement, and will interpretation issues. Gabrielle successfully argued the case in court, obtaining the entirety of the remainder of an estate for the client.
  • Acted as second chair in a bench trial in which Gabrielle and her team obtained a defense verdict on a motion for directed verdict at the close of plaintiff’s evidence.
  • Negotiated a high six-figure settlement on behalf of a nonprofit client named in a trust as a remainder beneficiary while avoiding litigation.
