Dinah Ortiz is a trial-experienced litigator and counselor who represents clients in trade secret, copyright, trademark and patent matters. Clients look to Dinah for assistance with intellectual property issues arising from publication of creative works and from development of a wide range of technologies.

In addition to her intellectual property practice, Dinah also leverages a strong track record in commercial matters involving business torts, unfair competition, partnership disputes, breach of contract and fraud claims. She also regularly litigates real estate disputes.

Dinah’s clients count on her to litigate cases from inception to the conclusion. As a result, Dinah has significant appellate experience as well, having handled numerous appeals and writ petitions before state Courts of Appeal and Federal Circuit Courts of Appeal.

Prior to joining the firm, Dinah practiced at Thoits Law, Morrison & Forerster, Alston & Bird and O’Melveny & Myers.

  • Represented an online retailer in copyright litigation with a competitor in the Northern District of California, resulting in entry of a stipulated judgment against the competitor.
  • Represented a multinational apparel company in domestic and international brand enforcement efforts in the Central District of California. Notable results included entry of a consent judgment of design patent infringement against another apparel company and a favorable settlement of a false advertising claim against a competitor.
  • Represented a multinational apparel company in litigation in the Central District of California regarding the accessibility of its stores and successfully moved for summary judgment, resulting in dismissal of the case. Obtained an attorneys’ fees award that was subsequently affirmed on appeal in the Ninth Circuit Court of Appeals.

  • Represent high net worth individual seeking to recover money loaned based on fraudulent representations by two individuals. After a court trial in the Los Angeles County Superior Court, the client secured a $1.2 million judgment, including more than $800,000 in attorney fees and costs.
  • Represented a major research, development and manufacturing company in trade-secret misappropriation and contract claims regarding DNA synthesis technology in the Santa Clara County Superior Court.
  • Defended award-winning digital signage software company in a patent and copyright case in the U.S. District Court for the District of Colorado dealing with digital wayfinding technology—in particular, systems and methods for programming and displaying directions for navigating between two map locations.
  • Defended global provider of voice and data recording solutions in a case in the U.S. District Court for the Southern District of New York involving patent that included features such as preventing unauthorized access to the recording; automated identification of sensitive information; and starting and stopping the recording to avoid recording sensitive information.
  • Represented plaintiff in asserting patent claims against a medical device company involving devices for endoscopic vein harvesting in the U.S. District Court for the Northern District of California.
  • Defended Chinese manufacturer of unmanned aerial technology against patent infringement claims in the U.S. District Court for the Central District of California involving features of drones, in particular a system for controlling the drone using target tracking and a platform for interchangeably mounting the drone.
  • Defended a U.S.-based multinational software corporation in an infringement case in the U.S. District Court for the Eastern District of Texas involving patents directed to methods and systems for automated pricing of the components used in a construction plan created with an architectural design tool, like CAD programs.
  • Defended a wind energy company in the U.S. District Court for the Eastern District of Wisconsin in a case alleging criminal trade secret misappropriation of source code for wind turbines.
  • Represented plaintiff, an automotive brake manufacturer, in a case alleging copyright and trade secret misappropriation involving technology related to CAD drawings for brake components in the U.S. District Court for the Northern District of  Illinois.
