A recent lawsuit against Workday is raising urgent questions about the legality and fairness of AI-powered hiring tools.
Lathrop GPM Partner Michael Manoukian was recently quoted by the San Francisco Business Times in a feature examining the implications of a collective-action lawsuit alleging discrimination by Workday’s AI-based applicant screening system. Manoukian discussed how new California regulations – effective October 1 – will heighten scrutiny of automated decision-making in employment, and emphasized the importance of record-keeping, transparency, and legal oversight.
“I think ultimately it’s going to be the employer’s burden to show that the algorithms in place have been trained in a way or set up and modeled in a way that are unbiased and neutral in terms of the decision-making process,” said Manoukian.
