Lathrop GPM Partner Pat Fanning was quoted in a recent Kansas City Business Journal article examining the rise in nuisance lawsuits against data centers.
Fanning notes that these cases reflect a new strategy for challenging data centers already in operation: “In the data center context, you are seeing an all-out war being fought at the ordinance or the permit level. The people who oppose data centers and are trying to stop them on the front end are falling back on nuisance lawsuits to try and combat them once they are built.”
While litigation around data centers is expected to grow, Fanning also outlined steps developers can take to strengthen their defense against these lawsuits.
