Joey Mark is a skilled litigator with a proven track record in resolving complex business and real estate disputes. As a member of the firm’s Litigation & Dispute Resolution practice group, Joey is focused on representing businesses, business owners and investors, developers, landowners, brokers, landlords, property managers and homeowners in general corporate and commercial real estate litigation disputes.

Joey is based in our Denver office and brings a deep understanding of Colorado’s commercial and real estate markets, having grown up in the Denver Metro area. Joey’s approach is practical and solution-oriented, emphasizing finding the best possible outcomes for his clients. He is known for his tailored, candid and informative counsel, empowering clients to make informed decisions throughout the legal process. Joey is experienced trying cases before judges and juries, prosecuting and defending appeals, negotiating complex and creative solutions and resolutions, and utilizing each state of the litigation process to advance his client’s goals.

Joey earned his J.D. from the University of Denver Sturm College of Law, where he served as the Articles Editor for the Denver Law Review. After graduating law school, Joey served as a judicial clerk for the Honorable Terry Fox on the Colorado Court of Appeals, where he researched and drafted appellate opinions on a wide range of legal issues.

Before joining Lathrop GPM, Joey was a partner at another prominent Denver-area law firm where his practiced commercial and real estate litigation.

In his free time, Joey enjoys being with his family and friends. He is an avid skier (going big), golfer, cyclist, fly fisherman and traveler.

  • Negotiated complex favorable settlement of easement dispute between commercial property owners involving prescriptive easement and adverse possession claims. 
  • Won bench trial and collected attorney fees for commercial tenant client in a breach of contract dispute with commercial landlord regarding enforcement of lease following tenant merger/acquisition.
  • Negotiated complex favorable settlement of commercial lease dispute for commercial landlord client involving commercial property purchase/sale with secured seller financing.
  • Won bench trial prosecuting claims to invalidate spuriously recorded real property deeds and successfully defended verdict through multiple appeals.
  • Won jury trial prosecuting breach of fiduciary duty claims against company executive including successful defense of interlocutory jurisdictional challenges and appeals and post-judgment appeals.
  • Won dispositive summary judgment motion for commercial broker client in commission dispute regarding commercial property listing agreement and subsequent sale.
  • Won bench trial and collected attorney fees for board member client in action against homeowners association board to enforce bylaws, declarations, and requirements of the CCIOA statute.
