Katy A. Fodness
Katy Fodness is an experienced litigator and advisor who counsels and represents higher education institutions and other entities in a variety of matters. She has represented clients in disputes involving discrimination, harassment, retaliation, failure to accommodate, negligent hiring and supervision and tortious interference with contract before state and federal courts. She has successfully tried cases and advocated for her clients in state and federal courts, as well as administrative agencies including the Equal Employment Opportunity Commission (EEOC), U.S. Department of Labor, Minnesota Department of Human Rights, and Minnesota Department of Labor and Industry OSHA.
Combining her litigation experience with a tailored understanding of each client’s unique operations, needs and goals, Katy also regularly advises clients on a wide range employment issues, such as leave and accommodations; reductions in force; investigations of internal complaints of discrimination or harassment and workplace misconduct; the rights of service members and veterans under the Uniformed Services Employment and Reemployment Rights Act; and compliance with state and federal wage and hour law.
In addition, Katy collaborates with clients to create policies for prevention and investigation of protected class-based discrimination and harassment, affirmative action plans and practices for effective risk management. She has trained executives and managers on responding to complaints of harassment, wage and hour issues and employee performance management, including the creation of employee discipline and performance improvement plans.
Before joining the firm, Katy served as an Assistant Attorney General with the Minnesota Attorney General’s Office for six and a half years. She focused her previous practice on employment defense and advising, frequently representing Minnesota State Colleges and Universities, the Department of Public Safety, the Department of Revenue, the Department of Human Services, the Department of Commerce, the Department of Corrections and other state agencies.
