Health Law Roundtable: Shine a Light: New “Sunshine” Regulations to Require Disclosure of Physician Payments from Drug, Device, and Other Companies

Center for Medicare & Medicaid Services (CMS) has finally issued the final regulations implementing the Physician Payment Sunshine Act that was part of the Affordable Care Act. The Sunshine Act regulations clarify the requirements of manufacturers of drugs and devices to report various payments made to physicians and teaching hospitals. Affected manufacturers will be required to begin collecting the payment data in August 2013 and begin filing reports with CMS by the end of March 2014. CMS will make the reported information publicly available on a new website, with the goal of increasing transparency about financial relationships and potential conflicts of interest in the health care industry.

What happens if physicians disagree with the reports that are filed?
Penalties for noncompliance are substantial, and include annual fines of up to $1 million annually for “knowing” failures to report.
