St. Louis Business Journal Features First Subchapter V Case in the Eastern District of Missouri, Led by Wendi Alper-Pressman


Partner Wendi Alper-Pressman represented Ben F. Blanton Construction Inc. in its Chapter 11 reorganization case. Blanton filed for Chapter 11 in July 2020 and elected to proceed under the newly created “Subchapter V” of the bankruptcy code, which allowed the company to have an expedited bankruptcy and avoid significant statutory fees.

As a result of the filing, Blanton was able to reorganize, with all classes of the creditors accepting the plan, and continue its operations, while funding its plan with insurance proceeds and only a fixed contribution from the company. Not only was this a success for the client, but Wendi was able to confirm the first Subchapter V case in the Eastern District of Missouri.
