Proposed Revisions to the Stark Law and Anti-Kickback Statute: What You Need to Know

Earlier this year, the Centers for Medicare & Medicaid Services (CMS) announced that long-anticipated changes to the Stark Law would be issued by the end of 2019. According to the agency, the new regulations “will represent the most significant changes to the Stark Law since its inception.”
On October 9, 2019, CMS made good on this promise and proposed significant changes to reform the Stark Law and Anti-Kickback Statute. The Stark Law regulations would create new exceptions for value-based arrangements, make changes to the definition of fair market value, commercial reasonableness, what it means to take the volume or value of referrals into account, the definition of designated health services, and would update compensation rules for group practices. The Anti-Kickback Statute regulations propose to create new safe harbors for value-based arrangements and care coordination services, make changes to permit incentivizing patients to follow treatment plans, and modify a number of existing safe harbors.
