2017 was another banner year in fraud and abuse enforcement, with the Department of Justice bringing in more than $2.4 billion under the False Claims Act alone. And 2018 is off to a busy start. In just a few short months:

  • The OIG has continued to bless gainsharing arrangements even while CMS has issued mixed messages about new reimbursement models;
  • Civil monetary penalties for health care fraud have increased (following 2017’s increase in False Claims Act fines to $21,916 per claim);
  • Enforcement agencies have continued to focus on holding individuals accountable for their role in health care fraud through OIG exclusion and individual criminal prosecution; and
  • OCR’s preliminary results from Phase 2 of the HIPAA Audit Program were released, and the results were surprisingly bad.

These developments stand to have a significant impact on organizations and their compliance programs.
