The explosive use and reach of online social media sites and the rapid evolution of information technology has forever changed the way we communicate, work, and live. The employer-employee relationship is particularly impacted by this fundamental shift. In this environment, managing employee use of information technology can feel like trying to hit a rapidly moving target. Employers should be aware of the employment and labor law issues created by the continued spread of social media sites and other advances in information technology. In this presentation we will summarize those issues, ranging from privacy and federal stored communications laws, to protected activity under federal labor laws, to safeguarding employers’ confidential information. The presentation will also offer practical tips on how employers can avoid some of the recognized pitfalls that can arise in connection with employees’ use of social media and other information technology. Although technology may seem to change every day, employers that set thoughtful boundaries for use and supervision have a head start in this evolving frontier.
