Higher Education Alert: Proposed Title IX Regulations Released

The U.S. Department of Education released proposed Title IX regulation changes on Nov. 16, 2018 that, if approved, will impact how higher educational institutions throughout the nation respond to sexual harassment reports. As institutions face the ever-changing Title IX legal landscape, training and compliance remain critical.

The proposed regulations are broad ranging and apply to many aspects of institutions’ policies and procedures. Most impactful is a new provision mandating that every institution hold live hearings with an opportunity for cross-examination.  

The proposed federal regulations are now in the note-and-comment process, which closes 60 days from the date the proposed regulations are published in the Federal Register.
