In the wake of a recent Supreme Court decision and a new presidential administration, employment attorneys and their clients should prepare for an increase in litigation over the Employment Retirement Income Security Act (ERISA).

Lathrop GPM Partner Rick Bien weighed in on the new developments in a Missouri Lawyers Weekly article, noting that the Supreme Court has now left it up to the courts to determine the “best meaning” of federal regulations. Shifting enforcement priorities under a new administration may also impact the regulatory landscape, with new waves of litigation impacting the Affordable Care Act and employer-sponsored health plans.
