Casey Breese & Amy Erickson will provide an overview and explanation of the fiduciary’s duty of prudence, highlighting common scenarios that can lead to violation of the duty, the potential consequences of a violation and tips for successfully navigating tricky situations involving the duty of prudence. Casey and Amy will also more broadly discuss the circumstances that commonly subject trustees to legal claims and provide practical tips fiduciaries should follow to minimize litigation risk and, if necessary, to successfully navigate litigation.
