This alert is another follow up to this post on court activity related to the Corporate Transparency Act (“CTA”). On December 26th the Merits Panel of the 5th Circuit Court of Appeals reinstated the nationwide injunction imposed by the federal district court. As a result, pending additional court actions, presently there is no deadline for Reporting Companies to complete their Beneficial Ownership Information Report (“BOIR”) filings. The order allowed the expedited briefing schedule set by the 5th Circuit Motion Panel to stay in place. The volatility of this issue is unusual and timing for potential required future filings is uncertain until the courts have resolved this matter.
