Danielle N. Twait

Danielle Twait has extensive litigation experience in a broad range of matters in federal and state courts such as defamation, invasion of privacy, commercial contractual disputes, class actions, intellectual property disputes, consumer fraud claims, large real estate foreclosures, gaming industry tax litigation, and bankruptcy proceedings.

Outside of the courtroom, Danielle provides legal counseling to clients on a variety of business related matters including employment issues and trademark and copyright protection.

Representative Matters

  • Prevailed on a temporary restraining order and then in a three-day preliminary injunction obtaining an order freezing the sole owner's assets, based on the theory of alter ego, to collect on a default judgment against the defunct entity. Urban One, Inc. v. Tucci, Case No. 17-cv-7892, 2018 WL 4714847 (N.D. Ill Sept. 30, 2018)
  • Successfully obtained a dismissal with prejudice on behalf of several defendants including the American Bar Association against claims of defamation, false light, false advertising under Lanham Act and deceptive advertising under various state consumer protection statutes. Board of Forensic Document Examiners Inc., et al. v. American Bar Association, et al., 287 F.Supp.3d 726 (N.D. Ill. 2018)
  • As lead trial counsel on behalf of a national lender, obtained a judgment in favor of the bank protecting the priority of bank's deed of trust over mechanics' liens. (St. Louis City, Missouri)
  • Successfully obtained a reversal of a trial court order denying the client’s right to move to dismiss for lack of personal jurisdiction. State ex rel. Promise Healthcare Inc. d/b/a Promise Hospital of San Diego v. Farragut-Hemphill, 2012 WL 452663 (Mo.App. E.D., February 14, 2012) (representing Promise Healthcare Inc.)
  • Represented a coalition of television companies, newspaper companies, and media industry organizations in successfully obtaining an order denying a proposed gag order in a Wisconsin criminal matter. (Wisconsin state court)
  • Prevailed on appeal where the Court affirmed the client’s (a law professor) motion to dismiss against claims of defamation and false light.  (Illinois Appellate Court, Fifth District)
  • Successfully obtained an order from the Illinois Appellate Court affirming the granting of the client’s (an insurer) motion for summary judgment on plaintiff’s breach of contract and promissory estoppel claims. (Illinois Appellate Court, Second District)
  • Prevailed on a motion for partial summary judgment defending against claims for tortious interference and promissory estoppel. (Cook County, Illinois)
  • Secured summary judgments in favor of several national lenders on claims for recovery and on borrowers' counterclaims (St. Louis County and St. Charles County, Missouri)
  • On behalf of a national lender, secured ruling granting Daubert Motion prohibiting owner's lay valuation testimony in support of damages claimed. (E.D. Missouri)
  • Defended client in class action lawsuit against allegations that its website violated the Americans with Disabilities Act (E.D. New York)
  • Defended clients in lawsuits alleging violations of the Telephone Consumer Protection Act and Fair Debt Collection Practices Act (N.D. Illinois and E.D. Missouri)
