On May 6, 2020, the Department of Education released its final Title IX regulations, including a new provision mandating that every institution hold live hearings with an opportunity for cross-examination. In addition to the final regulations, the Department released a preamble totaling more than 2,000 pages, which includes guidance from the Department on the regulations, including the live hearing provision. With an effective date of August 14, 2020, institutions need to move quickly to adopt a hearing process that meets the requirements of the final regulations.

Join us for a 2.5 hour in-depth training discussing how to conduct a live hearing in compliance with the final regulations. This session will address the requirements for cross-examination, the role of advisors during a hearing, relevancy issues, places where your institution has flexibility on how to structure the hearing process, and more.

Our training will be conducted by Higher Education attorneys specializing in Title IX compliance who have worked with the Department of Education on these very issues. Because these attorneys also have extensive experience investigating and adjudicating sexual misconduct cases for institutions, this training incorporates firsthand, real world experience and provides practical advice on navigating the complex issues that arise during the hearing process.
